Jeffrey A. Feasby

Experience

Jeff A. Feasby’s practice focuses primarily on defending clients in complex civil litigation matters involving securities, unfair competition, fiduciaries, corporate governance, and intellectual property. He has experience litigating consumer class actions and other complex business disputes before various courts and arbitration forums throughout the country. Mr. Feasby has defended and prosecuted cases involving claims of securities and common law fraud, unfair competition/business practices, breach of fiduciary duty, breach of contract, corporate governance, copyright and trademark infringement, trade secret misappropriation, as well as other business-related torts.

Mr. Feasby received a degree in history from the University of Colorado. He earned his JD, cum laude, from the University of San Diego. While at USD, he worked as an extern for the Honorable Ruben B. Brooks, Magistrate Judge for the United States District Court, Southern District of California.

Since 2000, Mr. Feasby has successfully represented clients in all aspects of litigation, from the inception of the case, through trial, and on appeal. He is admitted to practice before State and Federal courts in California and Texas, including the United States Court of Appeals for the Ninth Circuit and the United States Court of Appeals for the Fifth Circuit.

Jeff is an active volunteer in the local community, having worked pro bono to try cases for the County of San Diego and for individual clients through the San Diego County Volunteer Lawyer Program. He also serves on the Board of Directors of the First San Diego Courthouse and previously served on the San Diego Chamber of Commerce’s Education and Workforce Development Committee.

Notable Engagements

• Lead trial counsel in three-week federal jury trial representing franchisor in dispute with franchisees and area representative over claims for breach of contract. Jury awarded client over $1.5 million in damages and Court separately awarded client $800,000 in attorneys’ fees.
• Represented local company and its founder in JAMS arbitration in bet-the-company case brought by investor claiming conversion of note resulted in its ownership of 100% of company. Arbitrator found that client properly removed investor as member for cause and awarded client almost $1 million in attorneys’ fees and costs. Arbitration award subsequently confirmed by court and judgment in favor of client entered thereon.
• Represented client in federal whistleblower case in District Court in Texas. In which entered summary judgment against client. Argued case to the Fifth Circuit Court of Appeals, which revered the District Court’s order and remanded the case for further proceedings. Case subsequently settled on favorable terms to client.
• With Mr. Pérez, obtained a jury verdict in Houston, Texas worth in excess of a billion dollars (now approaching $3 billion with interest) against the Petroleum Workers Union of the Republic of Mexico (an affiliate of PEMEX).  The trial was the culmination of over 30 years of contentious litigation.  The jury’s verdict was subsequently upheld on appeal.
• Obtained summary judgment for utility in class action brought by utility’s customers related to power failure that affected San Diego County, Imperial County, Orange County, and Riverside County.
• Represented telecom company in action filed against former president alleging breach of contract, extortion and defamation among other claims. Obtained emergency temporary restraining order and subsequent preliminary injunction enjoining former president and his related businesses from engaging in further extortive conduct. Initiated contempt proceeding after former president and his businesses violated the injunction on numerous occasions. Succeeded in convicting former president and his businesses of dozens of counts of contempt resulting in jail sentences.
• Represented defendant who was a minority investor in the plaintiff LLC in this trade secrets case.  After defeating plaintiff’s application for temporary restraining order, negotiated settlement in which client had the entire amount of his investment returned.
• District Court granted client’s motion to dismiss based on abstention doctrine due to pending probate proceeding in Mexico.
• Successfully represented local developer in action brought by environmental group to stop construction of Carlsbad business park.  Opposed plaintiff’s motion for preliminary injunction and obtained summary judgment in favor of client.
• Court of Appeal upheld trial court’s order granting client’s petition to confirm arbitration award.
• Court of Appeal upheld trial court’s judgment dismissal of action after sustaining client’s demurrer.
• Court of Appeal upheld trial court’s order denying the plaintiffs’ motion to set aside judgment after court granted client’s motion for judgment on the pleadings.
• Member of trial team that obtained a defense verdict for corporate clients on all of plaintiffs’ claims for slander, intentional and negligent interference with contractual relations, intentional and negligent interference with prospective economic advantage, and intentional and negligent infliction of emotional distress.
